The Court of Justice confirms that the action brought by families from the European Union, Kenya and Fiji against the EU ‘climate package’ of 2018 is inadmissible

In 2018, families from various Member States of the European Union (Germany, France, Italy, Portugal and Romania), as well as from the rest of the world (Kenya and Fiji), active in the agricultural sector or the tourism sector, and a Swedish association representing young indigenous Samis brought an action before the General Court of the European Union seeking the adoption by the Union of measures that are more severe than those laid down by a legislative package from 2018 1 in terms of reducing greenhouse gas emissions. They claimed, in particular, that the General Court should annul that legislative package inasmuch as it sets targets to reduce greenhouse gas emissions by 2030 by 40% compared to 1990 levels and, instead of awarding them pecuniary damages for their alleged individual losses, order the Council of the European Union and the European Parliament to adopt measures requiring a reduction in greenhouse gas emissions by at least 50% to 60%. By order of 8 May 2019, 2 the General Court declared that action inadmissible, as the persons bringing the action did not satisfy any of the locus standi criteria. It held, in particular, that the appellants were not individually concerned by the legislative package. The fact that the effects of climate change may be different for one person than they are for another does not mean that, for that reason, there exists standing to bring an action against a measure of general application. In its view, a different approach has the effect of rendering the requirements of the Treaty on the Functioning of the European Union (TFEU) 3 meaningless and of creating locus standi for all. Concerning the claim that the Council and the Parliament should be ordered to adopt more severe measures, which was made in the form of a claim for damages, the General Court considered that it sought, in reality, to obtain a result similar to the result of annulling the acts at issue and that, consequently, it also had to be declared inadmissible. 4

Council extends the mandate of Operation IRINI until 2023

The Council today extended the mandate of the EU Common Security and Defence Policy (CSDP) military operation in the Mediterranean - EUNAVFOR MED IRINI - until 31 March 2023. The decision was taken in the wake of the Strategic Review of the operation carried out by the Political and Security Committee. In this context, the Council has defined more precisely the practical arrangements for the disposal of items seized by the operation when implementing the UN arms embargo on Libya. Background EUNAVFOR MED IRINI (Greek for ‘peace’) was launched on 31 March 2020, shortly after the Berlin Conference on Libya in January 2020, as a concrete contribution on the part of the European Union to the process set up by the international community to support the return to peace and stability in Libya. Operation IRINI’s core task is to contribute to the implementation of the UN arms embargo on Libya, established by the UN Security Council Resolution 1970 (2011), through the use of aerial, satellite and maritime assets. In particular the mission is mandated to carry out inspections of vessels on the high seas off the Libyan coast suspected to be carrying arms or related material to and from Libya in violation of the arms embargo on Libya. It does this in accordance with United Nations Security Council Resolution 2292 (2016) and subsequent UNSC resolutions. In addition, Operation IRINI monitors violations perpetrated via aerial and land routes. It shares the information collected with the United Nations.
